Terms of Service
1. Who we are and what MATSIL Mobile is
1.1 These Terms of Service ("Terms") govern access to and use of matsilmobile.com, related subdomains, mobile surfaces, checkout flows, APIs, and MATSIL Mobile-operated features (together, the "Platform"), operated under the brand MATSIL Mobile ("MATSIL", "we", "us", "our").
1.2 MATSIL is a digital travel services platform. Unless content is clearly marked as original MATSIL material, we facilitate bookings and digital delivery for:
- eSIM data plans (including travel and lifetime-style products);
- tours and activities through third-party operators (including via Viator);
- car rental reservations through third-party rental providers.
1.3 Discontinued services: travel form processing and airport transfer booking are no longer offered. Historical records may remain for support and legal purposes only.
1.4 For most tours and car rentals, MATSIL acts as booking intermediary, not as the tour operator, vehicle owner, or network carrier. Third-party terms, cancellation rules, and safety requirements apply to the underlying service.
1.5 MATSIL is not a law firm, insurer, immigration adviser, or emergency service. Platform information is general and is not professional legal, medical, financial, or safety advice.
2. Acceptance and changes
2.1 By accessing or using the Platform, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Platform.
2.2 Where the Electronic Transactions Act applies, electronic acceptance (including clicking "I agree", creating an account, or continuing to use the Platform after notice) has the same effect as a written signature.
2.3 We may change these Terms. For material changes, we will give at least 30 days' notice by email to registered users (where we have an address) and/or a prominent on-site notice before the new effective date. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Platform and close your account.
3. Eligibility and accounts
3.1 You must be 18 or older to create an account or purchase paid services. The Platform is not directed at children under 18.
3.2 Car rentals may have additional minimum age, licence, and deposit requirements set by the rental provider.
3.3 You are responsible for activity under your account, for keeping credentials secure, and for accurate registration and booking information.
3.4 We may suspend or terminate accounts for breach of these Terms, fraud, chargebacks, abuse, or risk to the Platform or third parties, with or without notice where reasonably required.
4. Orders, pricing, and payment
4.1 All prices, taxes, fees, and currency are shown before checkout unless a mandatory fee is imposed later by law or by a third-party operator.
4.2 Payment is processed through Stripe or other designated processors. We do not store full card details on our servers.
4.3 An order is accepted when you receive written confirmation (email or in-account confirmation). We may cancel or refuse an order for pricing error, suspected fraud, provider unavailability, or legal restriction.
4.4 eSIM products are digital goods tied to account delivery and, where applicable, QR code generation.
5. Service-specific terms
5.1 eSIM. You must verify device compatibility, destination coverage, and activation steps before purchase. Once a QR code is generated and delivered, the plan is generally non-refundable except as stated in the Refund Policy. Coverage and speed depend on local networks and your device.
5.2 Tours and activities. Bookings are fulfilled by independent operators. Cancellation windows, meeting points, age limits, and refunds follow operator/Viator terms shown at checkout. MATSIL does not guarantee weather, staffing, or itinerary changes made by the operator.
5.3 Car rentals. Reservations are fulfilled by independent rental companies. Vehicle class, insurance, deposits, fuel, mileage, cross-border rules, and driver eligibility are set by the rental provider. Pickup disputes are primarily between you and the provider.
6. User responsibilities and prohibited conduct
You agree to:
- provide accurate, current, and complete booking and identity information;
- use the Platform only for lawful purposes;
- not impersonate others or misrepresent affiliation;
- not scrape, reverse engineer, or overload the Platform;
- not resell or commercially exploit Platform content without written consent.
You are responsible for passports, visas, licences, insurance, health requirements, and local laws at your destination.
7. Intellectual property
7.1 Third-party marks, tour content, rental listings, and network branding remain the property of their respective owners. MATSIL claims rights in its brand, software, layout, and original material.
7.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal travel booking in accordance with these Terms.
7.3 The Copyright Act and applicable fair dealing or licensing principles apply to reuse. Rights concerns: [email protected] (subject: Rights-Holder Complaint).
8. Disclaimers
8.1 The Platform is provided "as is" and "as available". To the fullest extent permitted by law, MATSIL disclaims warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement for third-party and user-supplied content.
8.2 We do not guarantee uninterrupted service, error-free activation, or availability of every tour, vehicle, or network.
8.3 Travel, health, legal, and official information on the Platform is general information only. Verify with qualified professionals and primary sources before acting.
9. Limitation of liability
9.1 To the fullest extent permitted by Jamaican law, MATSIL is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from use of the Platform.
9.2 Our aggregate liability for claims relating to the Platform (other than liability that cannot be excluded by law) is limited to the greater of (a) JMD 50,000 or (b) the fees you paid MATSIL for the specific service giving rise to the claim in the twelve (12) months before the claim.
9.3 These limits do not apply to death or personal injury caused by our negligence, fraud, or other liability that cannot be limited by law.
9.4 Where a third-party operator or provider supplies the underlying service, primary responsibility for performance, safety, and provider-side cancellation remains with them, except where MATSIL has independently caused loss through its own deliberate wrongdoing or negligence.
10. Indemnity
You agree to indemnify and hold harmless MATSIL and its operators from claims, losses, and reasonable costs (including legal fees) arising from your bookings, your breach of these Terms, your unlawful use of the Platform, or inaccurate information you provide, except to the extent caused by MATSIL's deliberate wrongdoing or negligence.
11. Consumer rights
Nothing in these Terms excludes non-waivable consumer rights under Jamaican law, including rights under the Consumer Protection Act where applicable. Refund eligibility is also governed by our Refund Policy.
12. Third-party links and services
12.1 The Platform links to operators, payment processors, and companion products. We do not control and are not responsible for their content, terms, or privacy practices.
12.2 Your use of Stripe, Viator, rental partners, or linked services is governed by their terms and policies.
13. Governing law and disputes
13.1 These Terms are governed by the laws of Jamaica.
13.2 The courts of Jamaica have non-exclusive jurisdiction, subject to mandatory consumer or constitutional provisions.
13.3 Before formal proceedings, the parties will attempt good-faith negotiation for 30 days after written notice to [email protected]. Either party may then refer the dispute to mediation through the Dispute Resolution Foundation (or successor). Arbitration under the Arbitration Act 2017 applies only by written agreement of the parties.
14. General
14.1 If any provision is invalid, the remainder stays in effect.
14.2 Failure to enforce a provision is not a waiver.
14.3 You may not assign your rights without our consent. We may assign our rights in connection with a reorganisation or sale of the Platform.
